The story began with the trial of a man named Carlos Simon Timmerman, a pizza delivery worker from New York, who was accused of possessing child pornography after customs officials found a DVD of adult films in his luggage while passing through San Juan Airport on his way back to his country. Customs officials claimed that the actress in the DVD, named Lubi Fuentes, appeared underage, leading to his arrest and prosecution.
During the trial, a pediatrician testified, stating that the actress appeared to be a child and had not reached legal age, which complicated Carlos’s case. The defendant’s lawyer, Hector Ramos Vega, had no choice but to try to contact the actress. He began tracking her down through her website and managed to persuade her to appear in court. Lubi agreed to help without asking for any payment for her testimony.
Lubi traveled from Spain to Puerto Rico for the trial at the government’s expense, having received a formal subpoena to appear as a witness. She presented her passport and ID card to the judge, proving that she was of legal age and not a child, and that she was nineteen years old at the time of filming the movie. This evidence was sufficient and decisive for Carlos’s immediate acquittal and undermined the credibility of the doctor who testified against him and the investigators who arrested him.
After Carlos’s acquittal, his lawyer commented that Lubi was not obligated to come and clear his client’s name, but she did so, and her appearance was crucial to the case. Carlos was extremely grateful and felt as if he had been born again.
